Only in the Ninth Circuit?

Only in the Ninth Circuit? The Metropolitan News-Enterprise today contains an article headlined "Ninth Circuit Reverses Sleeping Felon's Firearm Possession Conviction" that begins, "A divided panel of the Ninth U.S. Circuit Court of Appeals yesterday reversed a man's felon-in-possession-of-firearms conviction because he was asleep when police officers found him on a couch in an abandoned apartment with one gun on his lap and another leaning against his leg."

News from earlier this month reminded us that passed-out people are at risk of being turned into a surface for often crude graffiti. And now we learn, courtesy of yesterday's ruling of the U.S. Court of Appeals for the Ninth Circuit, that sleeping felons may be used as a storage site for firearms.

Fortunately, at least two Ninth Circuit judges on the three-judge panel that produced yesterday's ruling were unwilling to see sleeping felons be found guilty of additional federal criminal charges for having been exploited in that manner.

The FCC and ABC, Inc., are duking it out over that profound question, which has now reached the federal appeals court for the Second Circuit. The debate has drawn in some of the country's top legal advocates. Seth Waxman, for example, who leads the appellate practice at the elite firm WilmerHale, has been mentioned as a possible Supreme Court nominee during Barack Obama's presidential term. But first he will make the bold argument, on behalf of ABC, that the buttocks are not a 'sexual or excretory organ.' Never have been, never will be -- whatever the anatomically illiterate FCC says."

IRS is now turning some tax collection efforts over to private collection agencies. There are currently 3 firms authorized to pursue collections for the IRS but their efforts are going to be extemely limited insofar as what they can do to effect collections. In the first place, they can\'t actually collect any money! In the event a taxpayer chooses to pay up the checks or whatever have to be made out to the IRS who then pays the contractors a set percentage of the money collected.

But the question that most interests us is whether or not they are under FDCPA or not and therefore liable to being sued under FDCPA for any violations they might commit and the answer is no, they are not under FDCPA because it is not a consumer debt.

But here is what they are subject to:

Only a portion of the FDCPA is incorporated into collection practices under Title 26 of the US Code (IRC). Though any private right of action would not fall under the FDCPA, but rather IRC Sec. 7433

The Federal Courts have ruled that attorneys may not demand any fees whatever from a defendant in a judgment since the attorney has no contract with a debtor nor has he performed any service for the debtor.

An attorney only has a client relationship with the creditor and it is to the creditor to whom he must look for his fees, not the debtor. Therefore an attorney who demands and gets attorney fees from a debtor through judgment has committed a fraud upon the court, he has committed a fraud upon the debtor

Not only are there white papers put out by judges and other people in the court systems but there are also links into the court systems for many states where you can look up court cases as well.

Here are the audio recordings for a part of last night's (Friday, May 25th) conference call. Our callers were having such a great time learning from each other that we let the call go on for a whole hour of overtime. There was also another reason for letting the call go on for an hour of overtime and that was that the recorder messed up and so the entire call did not get recorded.

Menachem E. Lifshitz, a former partner at Bernstein, Liebhard & Lifshitz, pleaded guilty to a felony charge of falsifying his 2005 income tax return and paid $4.8 million in back taxes and interest Thursday. A federal magistrate judge in New York has ruled that a former prosecutor representing herself in a wrongful termination case does not deserve the usual latitude afforded pro se plaintiffs. The judge wrote that M. Cameron Kenny was bound by the decisions of her former counsel when she took over her own case. "Here, the 'incoming counsel' is the plaintiff, who is herself a lawyer. As such, she cannot expect 'the special allowances [courts] sometimes make for pro se litigants,'" he wrote.

McKesson Settles Class Action Suit for $350 Million

McKesson, the largest drug distributor in the U.S., has agreed to pay $350 million to settle a class action alleging it fraudulently hiked the price of more than 400 medications, including Lipitor, ranked by some indices as the world's top-selling drug as of September. A class of consumers and health and welfare funds sued in 2005, alleging violations of the Racketeer Influenced and Corrupt Organizations Act for allegedly falsely inflating the average wholesale price of the popular prescription medications.

Fragomen Del Rey Announces Associate Layoffs

Fragomen, Del Rey, Bernsen & Loewy confirmed on Friday that it had let go between seven and eight associates, along with some legal assistants and paralegals. Layoffs in the financial services market, which provides the 220-lawyer firm with many employment immigration matters, precipitated the move. Heading into next year, Chairman Austin Fragomen Jr. says the firm will likely curtail hiring until the cloudy economic forecast clears.

Lots of Revenue Rides on New Tessera GC

General counsel are often in the background. But Bernard Cassidy will be front and center as the new GC at Tessera. That's because the San Jose, Calif., company lives and dies by licensing and litigating its patents. Last year, Tessera brought in $159 million, or 81 percent of its total revenue, from royalties and licensing. The semiconductor packaging company is currently suing a whole host of companies for patent infringement both in district court and before the International Trade Commission.

Cravath Cuts Bonuses, Hints at 2008 Financials

Cravath, Swaine & Moore announced sharp cuts in end-of-year associate bonuses in a memo to the firm's staff late Thursday. In an interview with the Am Law Daily, Cravath's presiding partner said the "principal driver is what's happening to our clients. Every day we're seeing them laying off people. Our conclusion was we needed to be as sensitive as we could be." Cravath's memo follows Skadden's announcement last week that it would pay the same base bonuses as 2007.
